An insurance company is suing Miami in federal court to reclaim funds from – and stop future payments for – the legal costs of defending Commissioner Joe Carollo.
QBE Specialty Insurance Co. wants $5 million, most of which it paid Miami this year for expenses from five lawsuits a pair of local businessmen filed against Carollo for harassment and First Amendment violations.
The company says it has “no duty” to cover Carollo’s defense, citing a 1989 Florida Supreme Court denial that reasoned no one should “be able to insure against (their) own intentional misconduct.”
Carollo lost a $63.5 million judgment last year.
