Four Miami-Dade homeowners have sued Florida, arguing a 2003 law illegally forces limestone-blasting property damage claims out of court and into an administrative forum.
The plaintiffs – Dayron Leon, Miguel Martinez, Jorge Ortega II and Mayra Soto – say quarry blasts near their neighborhoods caused cracking, roof deterioration and plumbing leaks, with investigation and repairs exceeding $50,000.
Their complaint, filed in Miami-Dade’s 11th Judicial Circuit, names Attorney General James Uthmeier and CFO Blaise Ingoglia in their official capacities.
Represented in part by lawyer and Miami Lakes Council member Steven Herzberg, they contend Florida violates access-to-courts rights, trial protections and separation of powers.
